California is a community-property state. The income, property, and savings the two of you built during the marriage are generally owned 50/50 — no matter whose name is on the account. That includes the one almost everyone underestimates: his retirement. The portion of his 401(k), pension, or CalPERS account that grew during the marriage is community property, and half of that is legally yours.
